Peter has packaged this amalgamation of immigration law, real estate law, and business law into Business Immigrant, where he represents entrepreneurs, investors, and those of extraordinary ability in their respective fields, initially servicing their business immigration needs, and then, once they are in the U.S., servicing the legal needs of their respective enterprises.

Business Immigrant provides legal solutions for both immigrant and non-immigrant visas to its clients. Under the non-immigrant visa category, which offers an extended–albeit temporary–stay in the U.S., the practice is focused on the E-2 Treaty Investor Visa, which allows investors from certain treaty countries to come to the U.S. for a set time to manage their investment in a business; the L-1 Intracompany Transferee Visa, which is designed for executives and specialized key employees of foreign companies to move to the U.S. to either work at an already-existing U.S. office or to establish a new office; the O-1 Extraordinary Ability Visa, which is perfect for individuals who possess a top-level ability in the sciences, education, business, athletics or the arts and entertainment.

Under the immigration visa category, which ultimately leads to permanent residence (i.e., a Green Card), Business Immigrant helps its international clients obtain the employment-based EB-1 Visa for those with extraordinary ability (under EB-1A), for those who are outstanding professors or researchers (under EB-1B), or for those who are multinational managers and executives (under EB-1C). It is important to note that while the EB-1B and EB-1C visas require a U.S. employer’s sponsorship, the EB-1A Visa allows for self-petitioning. Moreover, Business Immigrant works with current O-1 visa holders on their path to adjusting their status to EB-1A to file for a Green Card. Further, the firm has been focusing on the employment-based EB-2 (NIW) Visa, which allows clients to bypass the long and tedious PERM process with the Department of Labor, provided their portable skill set is in America’s national interest.

Business Immigrant also advises clients on the EB-5 Immigrant Investor Program, which is analogous to the “golden visa” programs in other countries. It is, in fact, a “residency by investment” program, offering a pathway to a Green Card for foreign investors and their dependents once a minimum investment amount (which is increasing continuously) from a proven legal source of about a million dollars is made to purchase a U.S.-based business. However, more commonly, EB-5 visa investors pool their investments into a fund managed by approved regional centers that oversee large development projects (a lower investment threshold is available if the investment is made into a “Target Employment Area” in an underdeveloped area). The requisite investment, once made, must then create or preserve at least 10 long-term, full-time jobs for U.S. workers within about 2 years.
